Terms, Refunds, and Privacy

1. About Text2Sign

Text2Sign lets you upload a PDF, place signature fields, and send a legally binding e-signature request to a signer by text message (SMS). By using our website at text2sign.com, you agree to these terms.

2. Document credits (no account required)

Text2Sign does not require you to create an account or log in. When you send a document, you provide your email address. That email is how we identify you for billing, delivery of the signed PDF, and any unused document credits.

How credits work:

  • You may purchase a single send or a credit pack (for example, 5 or 10 documents). See our pricing for current options.
  • When you pay for a pack, credits are added to the email address you enter as the sender on the send form.
  • One credit is used immediately for the document you are sending at checkout. Any remaining credits stay associated with that same email address for future sends.
  • To use a remaining credit, start a new send and enter the same sender email you used when you purchased the pack. If credits are available, the send proceeds without additional payment.
  • Credits are not tied to a password or login session. We look up your balance by email only. If you use a different email address, we cannot apply credits from another email.
  • Signers do not need an account. They receive a link by text and sign in their browser.

Because credits are linked to an email address rather than a password-protected account, you are responsible for using a consistent email address and keeping access to that inbox. Credits are non-transferable except at our discretion.

3. Payments

Payments are processed by Stripe. Prices are shown in U.S. dollars before checkout. By completing a purchase, you authorize us to charge your selected payment method for the plan you choose.

4. Refund policy

Text2Sign sells digital document sends and prepaid credit packs. Because a credit represents the right to deliver one signature request, refunds depend on whether the service was successfully delivered or the credit is still unused.

When we issue refunds

We will refund your purchase or restore credits when:

  • Payment succeeded but the document was never sent due to a technical failure on our side, such as checkout completing but the signing request failing before delivery to the signer.
  • You were charged twice for the same send or purchase by mistake.
  • A credit was consumed in error because of a bug or system failure on our side, not because you submitted a new send.
  • We cancel the service and you have unused prepaid credits remaining on your sender email.

In these cases we will either restore the credit to your sender email or refund the applicable amount to your original payment method, at our discretion.

When refunds are not available

We generally cannot offer refunds when:

  • The document was sent successfully - once a signature request has been delivered to the signer, including by SMS, that credit has been used, even if the signer has not yet opened or signed it.
  • The signer declines, ignores, or expires the request - we delivered the service you paid for; the outcome depends on the signer.
  • Incorrect signer details were provided - for example, a wrong phone number or name entered on the send form.
  • You no longer need the signature after the request was sent.
  • Unused credits from a pack - prepaid credits do not expire, but remaining credits are not refundable simply because you did not use them. You can use them on a future send with the same sender email.
  • Chargebacks or payment disputes opened without contacting us first - please email us so we can resolve the issue directly.

Partial refunds for credit packs

If you purchased a credit pack and used some credits but not all, we do not offer partial cash refunds for the unused portion under normal circumstances. Unused credits remain on your sender email for future sends.

If you believe a pack purchase was made in error before any credits were used, contact us within 7 days of purchase. We may approve a full refund at our discretion if no sends have been delivered.

How to request a refund

Email info@text2sign.com with:

  • The sender email address used at checkout
  • The date of purchase
  • Your status page URL, if available, e.g. text2sign.com/status/...
  • A brief description of what went wrong

We aim to respond within 2 business days. Approved refunds are returned to your original payment method via Stripe and typically appear within 5-10 business days, depending on your bank or card issuer.

5. Your responsibilities

When using Text2Sign, you agree that you will:

  • Only upload documents you have the right to send for signature and use accurate signer contact information.
  • Obtain any consent required before sending SMS messages to signers, including compliance with applicable telemarketing and messaging laws.
  • Provide a valid sender email address where you can receive status updates and the completed signed PDF.
  • Not use the service for unlawful, fraudulent, or abusive purposes.

6. Document retention and link expiration

Signature requests expire after 7 days. If the signer has not completed the document within 7 days of send, the signing link will no longer work and the request cannot be completed through Text2Sign.

Stored copies are kept for 30 days from the date the document is sent. This 30-day period applies to:

  • Original and signed PDFs stored by Text2Sign
  • Status and download pages for that request
  • Copies held by our e-signature provider (BoldSign)

When the 30-day period ends, Text2Sign attempts to revoke and permanently delete the document from BoldSign and remove stored PDFs from our systems. After that point, downloads from Text2Sign will generally not be available.

You may still have a copy of the signed PDF in your email inbox if we emailed it to you when signing completed. We recommend downloading and saving important signed documents promptly. Text2Sign does not guarantee that a document can be retrieved after expiration.

Prepaid document credits do not expire when unused; only individual signing requests and their associated files are subject to these expiration and retention policies.

7. E-signatures and legal validity

Text2Sign uses third-party e-signature infrastructure to collect signatures and maintain an audit trail. In many jurisdictions, electronic signatures are recognized under laws such as the U.S. ESIGN Act and UETA, but validity can depend on the document type, industry, and location.

We do not provide legal advice. You are responsible for determining whether e-signature by text is appropriate for your specific document and situation.

8. Privacy policy

This privacy policy explains what information we collect, how we use it, and the choices you have. Text2Sign does not require you to create an account or log in. We identify senders primarily by the email address you provide when sending a document.

Information we collect

Information you provide

  • Sender email - used for billing receipts, delivery of the signed PDF, and storing document credits.
  • Signer details - name, mobile phone number, and optional email address, used to deliver the signature request.
  • Document content - the PDF you upload, signature field placement, and document title.
  • Payment selection - the plan you choose. Payment card details are collected and processed by Stripe; we do not store full card numbers on our servers.

Information generated by the service

  • Request status and timestamps, such as sent, viewed, signed, and completed.
  • Signed PDF copies after a document is completed.
  • Document credit balances associated with your sender email.
  • Payment and webhook records, such as Stripe session or payment intent IDs, needed to confirm purchases and troubleshoot issues.

Information collected automatically

  • Standard server and application logs, such as IP address, browser type, request timestamps, and error diagnostics, used to operate and secure the service.

We do not currently use advertising cookies or third-party analytics trackers on text2sign.com.

How we use your information

We use the information above to:

  • Process payments and apply document credits.
  • Send signature requests to signers by SMS and email, where applicable.
  • Store original and signed PDFs and make them available for download.
  • Email you when a document is completed, including the signed PDF as an attachment.
  • Display status updates on your request status page.
  • Provide customer support and handle refund requests.
  • Detect abuse, prevent fraud, and maintain the security of the service.
  • Comply with legal obligations.

How we share information

We share information only as needed to run Text2Sign. We do not sell your personal information.

  • Stripe- payment processing. Stripe's use of your data is governed by Stripe's privacy policy.
  • BoldSign - e-signature delivery, SMS notifications to signers, signature collection, and audit trails.
  • Resend - transactional email delivery to senders, such as completion notifications with signed PDF attachments.
  • Google Firebase - cloud storage for PDFs and database storage for request metadata and credit balances.
  • Hosting providers - infrastructure used to run the Text2Sign website and API.

We may also disclose information if required by law, to protect our rights or users, or in connection with a merger, acquisition, or sale of assets.

Document and status page access

Each send receives a unique status page URL. Anyone with that link can view limited status information for that request. Download links for signed PDFs are tied to the request ID. Treat status and download links as confidential and share them only with people who should have access.

Signers receive a separate signing link by text message from our e-signature provider. That link is intended only for the designated signer.

Data retention

Signing requests, PDFs, and related metadata are retained for 30 days from the date a document is sent, as described in the document retention section above. After that period, we attempt to delete stored PDFs and remove copies from our e-signature provider.

Document credit balances remain associated with your sender email until used or until we remove them in accordance with this policy or applicable law. Credits themselves do not expire solely because of the 30-day document retention policy.

You may request deletion of your data before the 30-day period ends by contacting us. We will honor reasonable deletion requests where we are not required to retain information for legal, security, or operational reasons, such as completed transaction records.

Security

We use industry-standard measures to protect data in transit and at rest, including encrypted connections (HTTPS) and restricted server-side access to stored documents and database records. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your choices and rights

Depending on where you live, you may have rights to:

  • Access the personal information we hold about you.
  • Request correction of inaccurate information.
  • Request deletion of your information, subject to legal exceptions.
  • Object to or restrict certain processing.

To exercise these rights, email info@text2sign.com. We may need to verify your identity, for example by confirming access to the sender email address associated with your requests or credits.

If you are a signer who received a text message from Text2Sign, contact the person who sent you the document or email us if you believe a message was sent in error.

Children

Text2Sign is not directed at children under 13, and we do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will take appropriate steps to delete it.

International users

Text2Sign is operated from the United States. If you use the service from outside the U.S., your information may be processed and stored in the U.S. and other countries where our service providers operate.

9. Service availability

We aim to keep Text2Sign available and reliable, but we do not guarantee uninterrupted access. Delivery of SMS messages depends on carriers and third-party providers outside our control. We may modify, suspend, or discontinue features with reasonable notice where practicable.

10. Dispute resolution and binding arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.

Informal resolution first

Most disputes can be resolved quickly by contacting us. Before starting arbitration or any formal proceeding, you agree to email info@text2sign.com with a brief description of the dispute and your contact information. We will try to resolve the matter informally within 30 days.

Agreement to arbitrate

If we cannot resolve a dispute informally, you and Text2Sign agree that any dispute, claim, or controversy arising out of or relating to these terms, the Text2Sign service, or any purchase or use of the service (collectively, "Disputes") will be resolved exclusively through final and binding arbitration on an individual basis, rather than in court, except as described below.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by this section. The AAA rules are available at adr.org. If the AAA is unavailable, the parties will select an alternative arbitration provider with substantially similar rules.

The arbitrator may award the same damages and relief that a court could award on an individual basis. The arbitration may be conducted by phone, video, or based on written submissions, unless the arbitrator determines a hearing is necessary. Unless the arbitrator finds the arbitration frivolous or brought for an improper purpose, Text2Sign will pay all AAA filing, administration, and arbitrator fees for claims that qualify as consumer disputes under the AAA Consumer Arbitration Rules.

Exceptions

Either party may bring an individual action in small claims court if the claim qualifies and remains in that court. Either party may also seek injunctive or other equitable relief in court to prevent unauthorized use or abuse of the service or infringement of intellectual property rights.

Class action waiver

You and Text2Sign agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

If a court or arbitrator determines that this class action waiver is unenforceable as to a particular claim or request for relief, then that claim or request for relief may proceed in court, but only after the remaining claims have been arbitrated.

Jury trial waiver

To the fullest extent permitted by law, you and Text2Sign waive any right to a jury trial for Disputes subject to this section.

Opt-out

You may opt out of this arbitration agreement within 30 days of first accepting these terms by emailing info@text2sign.comwith the subject line "Arbitration Opt-Out," your name, and the email address you use with Text2Sign. If you opt out, the arbitration provisions will not apply to you, but all other terms will remain in effect.

Governing law

These terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules, except to the extent federal law applies. For any Dispute not subject to arbitration, you and Text2Sign consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

11. Limitation of liability

To the fullest extent permitted by law, Text2Sign and its operators are not liable for indirect, incidental, special, or consequential damages arising from your use of the service, including lost profits, lost business, or disputes related to documents you send. Our total liability for any claim related to a specific send is limited to the amount you paid for that send or the credit used for it.

12. Changes to these terms

We may update these terms, refund terms, or privacy terms from time to time. The "Last updated" date at the top of this page indicates when they were last revised. Continued use of Text2Sign after changes are posted constitutes acceptance of the updated terms.
